Your use of rabaudio.com (hereafter the "Website"), which is owned and maintained by RAB Audio ("RAB Audio," "we," "our," "us"), is governed by the policies, terms, and conditions set forth below. Please read them carefully. We offer the Website, including all information, tools, products and services available from the Website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By accessing, using, or placing an order over the Website, you agree to the terms set forth herein. If you do not agree to these terms and conditions in their entirety, you are not authorized to use the Website in any manner or form whatsoever.

 

THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW IN SECTION 16 OR IF YOU OPT-OUT. PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION PROVISIONS IN SECTION 16 BELOW WHICH ALSO DESCRIBES YOUR RIGHT TO OPT-OUT.

The Privacy Policy is hereby incorporated into these Terms by reference and constitutes a part of these Terms. RAB Audio reserves the right to modify the privacy policy at its sole discretion.

 

SECTION 3: GENERAL CONDITIONS AND WEBSITE USER CONDUCT RESTRICTIONS All aspects of our Website are protected by U.S. and international copyright, trademark, and other intellectual property laws. You do not acquire any ownership or other rights by downloading or using the Website or any material on it. You agree not to use or attempt to use the Website or any products or services in any unlawful manner. You further agree not to commit any unlawful act or attempt to commit any unlawful act on or through the Website including: (1) hacking and other digital or physical attacks on the Website; (2) publishing vulgar, obscene, or defamatory material; or (3) any other unlawful act.

 

SECTION 4: PRODUCTS SOLD FOR PERSONAL OR PROFESSIONAL STUDIO USE You agree that any products you purchase from RAB Audio and/or our Website will be used for your personal or professional studio use. You agree that you will not resell, re-distribute, modify, or export any product that you order from the Website without prior written authorization.

 

SECTION 5: ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order). The material on the Website is provided as general information only. We reserve the right to modify the contents of this Website at any time, but we have no obligation to update any information.

 

SECTION 6: MODIFICATIONS TO THE WEBSITE AND PRICES We reserve the right at any time to modify or discontinue access to the Website without notice. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

 

SECTION 7: PAYMENT METHODS All charges are in U.S. Dollars. We accept Visa, Mastercard, American Express, Discover, Diners Club, Shop Pay, Apple Pay, Google Pay, and Meta Pay. By submitting payment information, you represent that: (i) you are fully entitled to use that card or account; (ii) all information provided is complete and accurate; and (iii) sufficient funds exist to pay the amount due. We are not responsible for any fees or charges that your bank or credit card issuer may apply.

SECTION 8: ORDER ACCEPTANCE Your electronic order confirmation does not signify our acceptance of your order. We reserve the right to accept or deny shipment to anyone for any reason. In the event we deny your order, you will be refunded back to your original form of payment.

SECTION 9: SHIPPING POLICIES We ship orders within the U.S. Only. Due to the professional nature and weight of our furniture, orders usually arrive within 3 to 5 business days with standard shipping, though processing can take up to 5 business days during high demand. Accurate shipping addresses and phone numbers are required. We are not responsible for late or missing shipments due to incorrect address information. If you discover a mistake after submitting an order, contact support@rabaudio.com immediately. We cannot guarantee modifications once an order has been processed.

SECTION 10: DELIVERY CONFIRMATION You agree that any delivery confirmation provided by the carrier is deemed sufficient proof of delivery to the cardholder, even without a signature.

SECTION 11: RETURN AND CANCELLATION POLICY Our policy lasts 30 days from the date of receipt. To be eligible for a return, your item must be unassembled and in its original packaging.

  • Cancellations: Orders canceled after payment has been captured are subject to a 3% non-refundable merchant processing fee.

  • Restocking Fee: All accepted returns are subject to a 30% restocking fee, which will be deducted from your final refund.

  • Return Shipping: Customers are responsible for all return shipping costs and arrangements.

  • Damages: You must inspect your order upon delivery. If the outer packaging is damaged, you must take clear photos of the box before opening. Contact support@rabaudio.com with photos of the packaging and product immediately. Items sent back without prior authorization will not be accepted.

SECTION 12: SOCIAL MEDIA Social media platforms are places of public information exchange. Neither these Terms nor our Privacy Statement apply to our Social Media Presence on third-party platforms. Comments expressed by users do not reflect the opinions of RAB Audio.

SECTION 14: DISCLAIMER OF WARRANTIES EXCEPT WHERE PROHIBITED BY LAW, THIS WEBSITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

SECTION 15: DISCLAIMER OF LIABILITIES EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT SHALL RAB AUDIO OR ITS OFFICERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE WEBSITE OR PRODUCTS. OUR TOTAL LIABILITY SHALL BE LIMITED TO USD $500.00.

SECTION 16: DISPUTE RESOLUTION BY MANDATORY BINDING ARBITRATION PLEASE READ THIS SECTION CAREFULLY. EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT ANY DISPUTE MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

  • Pre-Dispute Procedures: You must first contact us at support@rabaudio.com or via mail at Attn: Legal Department, 1507 South Olive Street, Door 18, South Bend IN 46619 to describe the dispute and seek a resolution.

  • Location and Governing Law: Arbitration shall be conducted in St. Joseph County, Indiana and governed by the laws of the State of Indiana.

  • Time Limit: Any claim must be commenced within 1 year after the claim arises.

SECTION 17: INDEMNIFICATION You agree to indemnify and hold harmless RAB Audio and its affiliates from any claims, damages, and expenses (including attorneys' fees) arising from your breach of these Terms or your violation of any law or third-party rights.

SECTION 18: THIRD-PARTY LINKS We are not liable for any third-party materials or websites linked from our store. Please review third-party policies carefully.

SECTION 19: TESTIMONIALS AND REVIEWS Anything you submit to the Website, including reviews or photos, becomes the exclusive property of RAB Audio. We reserve the right to use, copy, and publish such submissions for marketing purposes.

SECTION 20: ELECTRONIC COMMUNICATIONS You agree that electronic communications from us satisfy any legal requirement that such communications be in writing.

SECTION 21: ASSIGNMENT RAB Audio may transfer its contractual rights and obligations without further consent in the event of a merger or sale of assets.

SECTION 22: NO WAIVER Failure by RAB Audio to enforce any provision of these Terms does not constitute a waiver of such right or provision.

SECTION 23: SEVERABILITY If any provision of these Terms is determined to be unlawful or unenforceable, the remaining portions shall remain in full force and effect.

SECTION 24: ENTIRE AGREEMENT These Terms, and any policies posted by us, constitute the entire agreement and understanding between you and RAB Audio.
